for the Online Shop of Genschingo / JSB Business

1. Scope of Application

These General Terms and Conditions ("GTC") apply to all contracts concluded between

– hereinafter referred to as the “Seller” –

and its customers via the online shop of the brand Genschingo.

These GTC apply to both consumers (§ 13 German Civil Code – BGB) and entrepreneurs (§ 14 BGB), unless otherwise expressly stipulated.

Deviating terms and conditions of the customer shall not be recognized unless the Seller expressly agrees to their validity in writing.

3. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to submit an order.

By clicking the order button, the customer submits a binding offer to conclude a purchase contract.

The contract is concluded when the Seller accepts the order by means of an order confirmation email or by dispatching the goods.

The automatic confirmation of receipt of the order does not constitute acceptance of the contract.


4. Prices and Payment Terms

All prices stated include the applicable statutory value-added tax (VAT).

Any additional shipping costs are displayed separately during the ordering process.

The following payment methods are available:

  • PayPal

  • Shopify Payments (credit card and other payment methods offered via Shopify)

Payment is due immediately upon conclusion of the contract.


5. Delivery and Shipping

Delivery is available within the European Union and to Switzerland.

Shipping is carried out via DHL, Deutsche Post or shipping service providers of the fulfillment partner (e.g. GLS, Asendia, Spring or comparable providers).

Unless otherwise specified in the respective product description, delivery times are as follows:

  • Germany: 3–6 business days

  • EU and Switzerland: 4–7 business days

The delivery period begins on the day following receipt of payment.

Partial deliveries are permissible insofar as they are reasonable for the customer.


6. Deliveries to Switzerland

For deliveries to Switzerland, additional costs such as customs duties, import VAT or handling fees may apply. These costs are to be borne by the customer and must be paid directly to the responsible authorities or shipping service provider.


7. Digital Products

Digital content will be made available to the customer electronically after receipt of payment.

The right of withdrawal expires in the case of a contract for the supply of digital content not supplied on a tangible medium if the Seller has begun performance of the contract after the customer has expressly consented to the commencement of performance before expiry of the withdrawal period and has acknowledged that by giving such consent they lose their right of withdrawal.


8. Pre-Orders

For products designated as pre-orders, delivery will take place at the date specified on the respective product page.


9. Retention of Title

The goods remain the property of the Seller until full payment has been received.

In relation to entrepreneurs, the following shall additionally apply:

The entrepreneur is entitled to resell the goods subject to retention of title in the ordinary course of business. The entrepreneur hereby assigns to the Seller, at the time of conclusion of the contract, all claims in the amount of the invoice total arising from the resale against third parties.


10. Warranty

The statutory warranty rights shall apply.

For entrepreneurs, the warranty period is limited to 12 months from delivery of the goods.

Entrepreneurs are obliged to inspect the goods immediately upon receipt and to notify any recognizable defects in writing without undue delay. If such notification is not made, the goods shall be deemed approved.


11. Liability

The Seller shall be liable without limitation for damages resulting from:

  • Intent or gross negligence

  • Injury to life, body or health

  • Claims under the German Product Liability Act

In cases of slight negligence, the Seller shall only be liable for breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable damage typical for the contract.

Any further liability is excluded.


12. Force Majeure

If the Seller is unable to meet delivery deadlines due to force majeure (e.g. natural disasters, strikes, official measures, supply shortages), the delivery period shall be extended appropriately.


13. Applicable Law and Jurisdiction

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If the customer is an entrepreneur, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes shall be Mannheim, Germany.

For consumers, the statutory provisions on jurisdiction shall apply.


14. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.


15. Final Provisions

Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
